STATEN ISLAND, NY. (THECOUNT) — David Pena has been identified as the victim fatally shot while outside a Staten Island daycare Tuesday, according to Wednesday reports.
Officials say they responded to a report of a person assaulted on Tuesday at approximately 8:40 p.m., in front of a residential daycare center at 137 Osgood Avenue. When officials arrived, they discovered 30-year-old Pena suffering from apparent gunshot injuries.

Pena was shot several time in the torso.
Pena was transported to an area hospital where he was later pronounced dead of gunshot injuries.
The victim was found sprawled out on the ground, with a gun next to him, 101WINS reports.
Police found no shell casings nearby and don’t believe the gun that was found to be the murder weapon, the report says.
There are no arrests and the investigation is ongoing.
