CHICAGO, IL. (THECOUNT) — Chicago lead prosecutor Kim Foxx has been subpoenaed to appear in court by a retired appellate judge who’s pushing for a special prosecutor to investigate the handling of the case against actor Jussie Smollett, WashingtonTimes is reporting Sunday.

The Chicago Sun-Times reports that Sheila O’Brien also subpoenaed Cook County State’s Attorney Foxx’s top deputy and requested that Smollett appear at a hearing on her request.

Foxx was widely criticized after her office announced it was dropping all 16 charges against the Empire actor who claimed he was assaulted in an anti-gay attack in downtown Chicago.

Foxx has defended her decision to let Smollett off the hook adding she welcomed an independent investigation.

Foxx manages the nation’s second largest prosecutor’s office and oversees an office of over nearly 800 attorneys and 1,500 employees. She was elected to this position on November 8, 2016. She is the second African American, after Cecil A. Partee, to hold this position, according to wikipedia.
