VIA: A bench warrant was issued Tuesday for the arrest of Rochester City Court Judge Leticia Astacio.
Astacio had been summoned to court on Tuesday for allegedly violating probation after the ignition interlock device in her vehicle detected alcohol on her breath.
However, she will not be in the courtroom today. Astacio’s attorney, Ed Fiandach, confirmed today that she will be in Thailand until August.
So far, there have been several allegations that Astacio has violated the conditions of her DWI sentence. In April, all five of those allegations were dropped.
Court paperwork states an officer with the Monroe County Office of Probation believes there is reasonable cause that there was a test registered a BAC above the .05 percent threshold.
On April 29 at 12:30 p.m., the ignition interlock device on Astacio’s vehicle failed to start due to a BAC of .061 percent. However, the camera on the device did not capture an image of anyone blowing into the device.
Five minutes later, the camera captured a young woman who is not Astacio blowing into the device and registering a .00 BAC reading.
